1. Introduction

  1. Despite the fact that we basically never stop inventing, improving and testing new things for you, we never forget to think about your safety. That is why we protect your privacy with the most advanced procedures and technologies. We want to ensure that your personal data is only ever processed to the extent necessary and only for the necessary purposes in accordance with the applicable legal provisions, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”).

The purpose of this Privacy Policy (hereinafter the “Policy”) is to inform you about your rights in connection with the processing of personal data and the nature and scope of its processing when using the labotiq.com and peters-technologies.de websites (hereinafter the “LABOTIQ Websites”), including the use of the Websites by unregistered users, when purchasing goods or services in the e-shop at www.labotiq.com (hereinafter the “LABOTIQ SHOP”), when exercising the rights and obligations arising from the contractual relationship between you and the controller, when using your LABOTIQ ACCOUNT or when using other services and websites operated by the controller or by one of the companies affiliated with the controller through ownership or personnel (hereinafter the “LABOTIQ SERVICES”).

2. Sources and categories of personal data processed

  1. The controller processes personal data provided by you or collected by the controller in the course of executing your order.
  2. In particular, the controller processes your identification and contact details, voluntarily provided descriptive data, details of orders and their execution, data on the use of LABOTIQ SERVICES and login data.

3. Purpose, legal basis and duration of the processing of personal data

  1. We process your personal data for the following purposes:
    1. Use of the LABOTIQ websites
      The legal basis for the processing of personal data is the exercise of the operator’s contractual rights and obligations arising from LABOTIQ’s General Terms and Conditions.
      In particular, we endeavor to make surfing the LABOTIQ websites as high-quality and user-friendly as possible. In this context, we process data that may have the character of personal data, including, but not limited to, data related to your visit to LABOTIQ’s websites and the history of visits to LABOTIQ’s websites, information about your browser settings, screen resolution, internet connection, etc.
      We process personal data for this purpose for a period of one year from the last visit to the LABOTIQ websites.
    2. Customer account management – LABOTIQ ACCOUNT
      The legal basis for the processing of personal data is the exercise of the operator’s contractual rights and obligations arising from the General Terms and Conditions. Registration is required to manage the customer account – LABOTIQ ACCOUNT, during which we process identification, contact and other data that you enter in your customer account or subsequently add or change.
      We process the data provided for the duration of your customer account and for 3 years after its termination.

    3. Purchase in the LABOTIQ E-SHOP
      The legal basis for the processing of personal data is the processing of an order for goods or services and the exercise of the rights and obligations arising from the contractual relationship between you and the Controller in accordance with the General Terms and Conditions, as well as the fulfillment of the associated legal obligations. Orders require the provision of personal data that is necessary for the successful processing of the order (name, address and postal address, contact details, etc.). The provision of personal data is a necessary prerequisite for the conclusion and fulfillment of a contract; without the provision of personal data, the contract cannot be concluded or fulfilled by the controller.
      We process the personal data provided for a period of 5 years from the date on which the last order was placed in the e-shop.

    4. Provision of other LABOTIQ-SERVICES

      The legal basis for the processing of personal data is the fulfillment of the operator’s contractual rights and obligations arising from the terms and conditions applicable to the respective LABOTIQ SERVICE. For this purpose, we process in particular identification data such as your name, contact data such as your address, e-mail and descriptive data such as your order number, the identification of your device, protocol, etc. We process personal data for this purpose for a period of 5 years from the last login to the relevant LABOTIQ SERVICES.

    5. Provision of customer support services

      The legal basis for the processing of personal data for the provision of customer support services is, if you are our customer and you have provided us with your order number when requesting customer support, a legitimate interest in solving technical and commercial issues in connection with the ownership of a device or the use of another LABOTIQ SERVICE. If you are not our customer, the legal basis for the processing of personal data for the provision of customer services is your consent, which you give by contacting customer service by filling in the required data via the online communication tool available on LABOTIQ’s websites. For the purpose of customer support, we process identification data such as your name, contact data such as your e-mail address and, if applicable, descriptive personal data such as your order number or your purchase history, and we process the personal data provided for a period of 5 years from your last activity in solving a customer support request.

    6. Sending newsletters and other commercial communications

      In the case of registered users, the legal basis for sending the newsletter is the legitimate interest of the operator. For non-registered users, the legal basis for sending newsletters is the consent given by providing the e-mail address and sending the request to receive commercial communications from the LABOTIQ website. For sending commercial communications, we use the e-mail address you provide, which we keep for a period of 5 years after you provide it.

  2. The controller deletes the personal data after the retention period has expired.

  3. The controller does not carry out automated individual decision-making or profiling of users within the meaning of Article 22 of the GDPR.

4. Your rights in relation to the processing of personal data

According to the provisions of the GDPR, you have the following rights as a data subject:

  • the right to information about your personal data in accordance with Article 15 of the GDPR;
  • the right to rectification of personal data in accordance with Article 16 of the GDPR or the restriction of processing in accordance with Article 18 of the GDPR;
  • the right to erasure of personal data in accordance with Article 17 of the GDPR. However, the controller declares that after exercising your right to erasure of your personal data, the processing of such personal data, which is necessary for the fulfillment of financial, tax and other legal obligations to which the controller is subject, as well as for the establishment, exercise or defense of legal claims, will continue after the controller has made use of your request;
  • the right to object to processing on the legal basis of legitimate interests or for the purpose of direct marketing in accordance with Article 21 of the GDPR;
  • the right to data portability in accordance with Article 20 of the General Data Protection Regulation;
  • the right to withdraw consent to the processing of personal data at any time;
  • the right to unsubscribe from receiving commercial communications, i.e. to withdraw consent to the associated processing of personal data via the link contained in the communications;
  • the right to obtain a copy of the standard contractual clauses concluded by the controller pursuant to Article 46 of the General Data Protection Regulation.

5.Disclosure of personal data to third parties

  1. You acknowledge that personal data may be transferred to third parties, including but not limited to individuals
    – involved in the delivery of goods/services/fulfillment of payments under a contract;
    – provide services for the operation of the LABOTIQ e-shop and other services in connection with the operation of the LABOTIQ e-shop;
    – who provide customer support services;
    – that provide marketing services.
  2. With the exception of the recipients and categories of recipients listed below in this Policy, the Controller does not transfer personal data to countries outside the European Economic Area (“EEA”) or to international organizations. In cases where personal data is transferred to countries outside the EEA, the Controller shall take all measures provided for in generally applicable European data protection law to ensure adequate protection of personal data, in particular through standard contractual clauses on data protection adopted by the European Commission (or the supervisory authority and then the European Commission), which it shall provide for contractual agreements with each relevant recipient of personal data.

    – LinkedIn – tracks cookies and web usage
  4. LABOTIQ’s websites may also contain other links and functionalities to third-party services and social networks, such as Facebook, Pinterest, Twitter, Instagram, etc., which, if you decide to use them, may process your personal data, such as your IP address, the history of the pages you have visited, or store cookies or other technical means on your device, such as the Facebook pixel, etc. In this case, the processing of your personal data is subject to the policies adopted by the operators of these services and social networks, which are available on their websites

6. The conditions for the security of personal data

  1. The controller assures that it has taken all appropriate technical and organizational measures to protect personal data.
  2. The controller has taken technical measures to secure data storage and the storage of personal data in paper form. In particular, this includes secure/encrypted access to the Internet, encryption of customer passwords in the database, regular system updates and regular system backups.
  3. The controller ensures that only authorized persons of the controller have access to the personal data.

7. Cookies

  1. In order to improve the quality of the LABOTIQ SERVICES and facilitate their use, in particular to analyze data traffic and user behavior on the LABOTIQ websites, to personalize advertising and to make social media functions more accessible, the LABOTIQ SERVICES use cookies or other technical means that are stored on your end device (hereinafter “cookies”). The cookies may be stored directly by the controller or they may be cookies from third parties (see the recipients under point 5.3). These files may not directly contain personal data, but may assume the character of personal data in connection with other data.
